Former Deputy County Executive James Smith is facing charges of official misconduct pertaining to the ongoing Robutrad criminal investigation.
Smith was indicted on six charges of official misconduct, which is a misdemeanor. The charges are based on three separate incidents when Smith was allegedly informed of inappropriate conduct by Bob Morone or Robutrad workers. Smith is accused of failing to act, and acting in a matter that allowed the activities to continue, says District Attorney Mike Green.
"He was doing it with the specific intent that a benefit be obtained for the Republican Party," Green said.
County Executive Maggie Brooks released a statement regarding Smith's charges:
As I stated when my administration first uncovered wrongdoing and launched the investigation of Robutrad, no one in county government is protected from scrutiny or prosecution," she said. "We have fully cooperated with law enforcement in every possible way throughout this investigation. That process has now resulted in the indictment of James Smith, who has previously served in county government."
"We must now let the judicial process play out," she added. "The county will continue to fully cooperate with law enforcement, ensuring that investigators have access to all county personnel and information that they need to complete their work. Anyone who has violated the public's trust or has stolen from taxpayers will ultimately be held accountable."
