Bristol Myers Squibb has to settle a nationwide lawsuit for $389 million. The lawsuit, brought by 43 states including New York, accused the company of Medicaid fraud. The company allegedly reported inflated wholesale values of its drugs, which means New York State and counties like Monroe paid more for those drugs through Medicaid.
Monroe County will get $306,000 through the settlement - a portion of the money it overpaid for Bristol Myers Squibb drugs. The state will get $40 million.
The national settlement dealt with more than just the pricing fraud. The company also settled allegations of illegal marketing. One of the claims was that BMS representatives promoted the antipsychotic Abilify for pediatric use and treatment of dementia-related psychosis, says a press release from the State Attorney General's Office. Both are controversial uses of the drug and neither was approved by the FDA at the time the suit was filed. Abilify is used to treat symptoms of bipolar disorder as well as schizophrenia.
