City files suit against Thurston Road Realty

The City of Rochester has filed suit against landlord Peter Hungerford's company, Thurston Road Realty. Several properties owned by Hungerford have racked up dozens of outstanding city code violations, including 447 Thurston Road, which still has more than 68 outstanding violations — down from 72 just last week.

"Landlords and property managers have an obligation to keep their properties safe and habitable," said Corporation Counsel Tim Curtin. "In this case, Mr. Hungerford has been given multiple warnings and opportunities to correct outstanding violations at his properties, and his failure to do so means we must do what is in the best interest of our residents, his tenants."

In the suit, filed May 18 in Rochester City Court, the city says the proceeding is to compel Thurston Road Realty, LLC, to correct outstanding property code violations at two of Hungerford's properties, 447 Thurston Road and 967 Chili Avenue. If those fixes aren't made, the city is asking the court to appoint a receiver, who would collect rents, manage the property, and make repairs.


Along with the outstanding code violations, the suit states that Thurston Road Realty owes RG&E $24,000 for its Thurston Road property and $3,300 for its Chili Avenue building.
